The short version: be.intentional is a free app that offers ideas to help you connect with your wife. It isn't therapy or crisis help. Use it kindly and lawfully, don't copy or misuse it, and understand it's provided as is. Apple's standard app license also applies.

If you or someone else is in danger, or your relationship involves abuse, contact emergency services (911 in the US) or the National Domestic Violence Hotline at 1-800-799-7233.

1. Accepting these terms

These Terms of Use ("Terms") are an agreement between you and Charles Hills about your use of the be.intentional iPhone app (the "app"). By downloading or using the app, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the app.

2. Who we are

be.intentional is made and operated by Charles Hills, an individual developer ("we," "us," "our").

3. Eligibility and age

There's no minimum age to use be.intentional. The app is written for husbands, and its prompts are about marriage. If you're not old enough to agree to these Terms where you live, please read them with a parent or guardian.

4. What the app is

be.intentional gives you one short prompt each day, something to say, ask or do for your wife. You get one prompt a day. You can mark it done, skip it to get a different one, or save it for later, look back at your history, and set optional reminders. The app has no account and works entirely on your iPhone. It is free.

5. Not therapy, counseling or crisis help

The prompts are reviewed by a licensed marriage and couples therapist. Even so, be.intentional offers general encouragement and ideas only. It is not:

Using the app doesn't create a therapist-client or any other professional relationship with us or with the reviewing therapist. If your marriage needs more support, please reach out to a licensed counselor.

If you're in danger or your relationship involves abuse, contact emergency services or the National Domestic Violence Hotline, 1-800-799-7233. Don't use a prompt if doing so could put you or anyone else at risk.

6. Faith-based content

be.intentional is a faith-based app, and some prompts reflect faith-based values and ideas about marriage. They are offered as encouragement for your personal use. You're free to use, adapt or skip any prompt that doesn't fit your beliefs or situation.

7. Your license to use the app

We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on any Apple-branded iPhone that you own or control, as allowed by Apple's Usage Rules in the App Store Terms of Service (including use by other accounts in your Family Sharing group, where Apple allows it). The app is licensed, not sold, to you.

Except where the law expressly allows it, you may not:

8. Apple terms

The app is distributed through Apple's App Store. Apple's Licensed Application End User License Agreement ("Apple's Standard EULA") also applies to your use of the app. These Terms add to it. In addition, you and we agree that:

  1. Agreement is with us, not Apple. These Terms are between you and Charles Hills only, not with Apple. We, not Apple, are solely responsible for the app and its content.
  2. Maintenance and support. We alone are responsible for any maintenance and support for the app, as described in these Terms or required by law. Apple has no obligation to provide any maintenance or support for the app.
  3. Warranty. To the extent any warranty applies that the law doesn't allow us to disclaim, we, not Apple, are responsible for it. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, you paid for the app (be.intentional is free, so this is typically zero). To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, subject to these Terms.
  4. Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including (a) product liability claims, (b) claims that the app fails to meet any legal or regulatory requirement, and (c) claims under consumer protection, privacy or similar laws.
  5. Intellectual property claims. If a third party claims that the app or your possession and use of it infringes that party's intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
  6. Legal compliance. You confirm that (a) you are not located in a country that is subject to a US Government embargo or that the US Government has designated as a "terrorist supporting" country, and (b) you are not on any US Government list of prohibited or restricted parties.
  7. Third-party terms. You must comply with any applicable third-party terms when using the app (for example, your wireless carrier's terms).
  8. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple will have the right (and will be considered to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

9. Acceptable use

Please use the app with kindness and respect toward your wife. You agree not to use the app:

10. Your data

Everything you enter and your prompt history stay on your iPhone, as described in our Privacy Policy. We don't receive or back up your data, so you're responsible for it, including any device backups you make. You can erase it at any time in Account → Delete my data. If you copy or share a prompt outside the app, you're responsible for that.

11. Reminders

If you turn on reminders, the app schedules local notifications on your iPhone. You can turn them off in the app's Account screen or in iPhone Settings. Delivery depends on your device and settings (for example, Focus modes or notification permissions) and isn't guaranteed.

12. Intellectual property

The app and its content, including the prompts, text, design, graphics, logo and the name "be.intentional," are owned by Charles Hills or his licensors and are protected by copyright, trademark and other laws. These Terms don't give you ownership of anything in the app. You may use the prompts for your own personal, non-commercial purposes, but you may not copy, republish or sell the prompt library or other app content.

13. No guaranteed outcomes

Prompts are suggestions. We don't promise any particular result, whether better communication, a stronger marriage, spiritual growth or any response from your wife. You decide whether, when and how to use any prompt, and you're responsible for those choices.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE APP WILL MEET YOUR NEEDS, OR BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT IS SUITABLE FOR YOUR SITUATION.

Some places don't allow certain warranties to be excluded, so some of these exclusions may not apply to you. Nothing in these Terms limits rights you have under consumer protection laws that can't be waived.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, PERSONAL OR RELATIONSHIP HARM, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP, EVEN IF WE'VE BEEN TOLD SUCH DAMAGES ARE POSSIBLE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50.

Some places don't allow these limits, so they may not fully apply to you. In that case, our liability is limited to the fullest extent the law allows. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.

16. Indemnity

To the extent the law allows, you agree to defend and indemnify us against claims, losses and costs (including reasonable legal fees) arising from your misuse of the app, your sharing of prompts or content outside the app, or your violation of these Terms or the law, except to the extent caused by our own willful misconduct.

17. Termination

You can stop using the app at any time by deleting it (use Account → Delete my data first to erase your data). Your license ends automatically if you break these Terms. We may also stop offering or supporting the app at any time. When your license ends, you must stop using the app and delete it. Sections that by their nature should continue (including intellectual property, disclaimers, limitation of liability, indemnity and governing law) will survive.

18. Changes to the app and these Terms

We may update the app and these Terms from time to time. When we change these Terms, we'll post the new version on this page and update the "Last updated" date. If a change is significant, we'll give notice in the app or on this site. If you keep using the app after changes take effect, you accept the updated Terms, except where the law requires your express consent.

19. Governing law

These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-law rules, unless the consumer protection laws where you live require otherwise. Courts located in North Carolina will have exclusive jurisdiction over any disputes, subject to any rights you have as a consumer to bring a claim where you live.

20. General terms and severability

If any part of these Terms is found unenforceable, it will be enforced to the maximum extent possible and the rest of the Terms will stay in effect. These Terms, together with our Privacy Policy and Apple's Standard EULA, are the entire agreement between you and us about the app. If we don't enforce a provision right away, that isn't a waiver. You may not transfer your rights under these Terms; we may transfer ours to someone who takes over the app.
